The Marshfield landowner who planned to build soccer fields for the town’s Youth Soccer program if he received an excavation permit, is now suing the Board of Public Works.
Selectmen denied an earth-removal permit to Peter Armstrong back in June, canceling his plans for the soccer fields.
The suit claims Marshfield tresspassed by depositing earth on his land and raising the grade to create a water-detention basin on adjacent town property.
It also claims the work lacked the proper permits, and seeks to clarify a deed restriction on Armstrong’s land.
Both items must be resolved in order for him to move forward with alternative development plans in light of the permit denial.
