Plymouth County District Attorney Tim Cruz and Duxbury Police Chief Matthew Clancy today announced that a Guatemalan man has been charged with Misleading a Police Investigation in connection with the ongoing investigation into the human remains found in Duxbury on July 27.
45 year-old Jose Milthon Freddy Azurdia-Montenegro of Guatemala has been charged with one count of Misleading a Police Investigation. The defendant will be arraigned in Brockton District Court.
On Sunday, July 27, at approximately 11:36 a.m., Duxbury Police received a call reporting a suspicious box at the intersection of Alexander Way at Walker Road in Duxbury. Upon arrival, Duxbury Police located the box, which had been partially opened. A strong odor was detected emanating from within. Duxbury Police notified the State Police Bomb Unit, which responded to the scene. The Duxbury Fire Department and the Department of Fire Services Hazardous Material Team also responded. The State Police Bomb Troopers x-rayed the package and determined that the package contained what appeared to be human remains. The State Police Detectives assigned to the Plymouth County District Attorney’s Office were notified and responded to the scene. The State Police Crime Scene Services Section and the State Police Crime Lab also responded to assist in processing the scene.
The remains were transported to the Office of the Chief Medical Examiner for examination and identification. An autopsy was conducted. The cause and manner of death are pending further testing. The deceased was identified through fingerprint analysis by the Department of Homeland Security as 44 year-old Estuardo Leonel Melgar Perez, a resident of Guatemala. A 14 inch incision was observed on the abdomen of the deceased.
Investigators have determined that Melgar Perez entered the United States on July 25, 2014 through JFK International Airport on a flight from Honduras. Melgar Perez was scheduled to leave the United States on August 2nd on a flight to Honduras leaving out of JFK. The defendant was also scheduled to be on that flight.
