20 Housing Units Allowed By-Right for Plymouth Chiltonville Parcel, Planning Board Alternate says Special Permit Needed for 60 Units

In Plymouth, Steven Bolotin, who serves as an Alternate member on the Planning Board, reached out to WATD to offer clarification on the 25 acres of land at 46 Sandwich Road in Chiltonville, owned by Holtec—and recently sold to developer Rick Vayo, who wants to build just over 60 units there. 

Special Town Meeting next month will consider purchasing this property from him for close to $4 million. Bobbi Clark has more.

Steven Bolotin talks about what is allowed on the Chiltonville parcel, as of right.

“The property is zoned, R40. R stands for residential, 40 stands for forty thousand square feet—which is just slightly under an acre. In that zoning, what you can build, as a matter of right, are single family homes on just slightly under one acre lots.”

So, how many homes could be built on that site?

“Roughly, 20 homes, given that there has to be some space, obviously for infrastructure, roads and septic and the like.”

Bolotin explains that in order to build 62 units on the Chiltonville site, the developer would need to get a special permit:

“So, that involves putting in an application to the Planning Board, having a public hearing and having it voted on—and you need at least 4 members of the Planning Board to approve it. The Planning Board takes a vote and depending upon whether they vote in favor or against, that will make a determination as to what he’s entitled to build, and any party who objects to that, can petition the Zoning Board of Appeals to review it and overturn it.”

And according to Bolotin, Mr.Vayo does not have an application pending:

“He withdrew his application at the Planning Board meeting on May 4th – saying that he needed some additional engineering studies.”

Is there a time limit to re-apply to the Planning Board?

“No, there isn’t, but he had indicated at the May 4th meeting that he was looking to change the dates towards the end of June, so after the Special Town Meeting.” 

This means that the developer may not have to apply for anything at all, if Town Meeting agrees to purchase the property at the Special Town Meeting on June 21st.
