A not guilty plea has been entered by a man charged with fatally shooting a 26 year-old Brockton man in 2022.
The Plymouth County District Attorney’s Office says that 24-year-old David K. Lynch was arraigned from his hospital bed on Friday at Boston Medical Center on one count of Murder. He pleaded not guilty and was held without bail.
The charges stem from an incident on the evening of November 2, 2022, when first responders arrived at 19 West Park Street and found a male, identified as 26 year-old John Depina, suffering from a gunshot wound to his right shoulder.
Depina was transported to Good Samaritan Hospital before being medflighted to Boston Medical Center where he was pronounced dead.
Investigators reviewed surveillance video that showed a newer Nissan Altima with excessive window tint, stop in front of 19 West Park Street where Lynch and Depina argued.
The video then showed the motor vehicle leaving the scene and Depina grabbing his right upper chest area.
It was then discovered that Lynch was on GPS monitoring with Massachusetts Probation Services and Lynch’s GPS was detected in the area of 19 West Park Street at the time of the shooting.
Police searched locations in Brockton and Weymouth and Lynch’s GPS bracelet was found discarded in Brockton.
He was found this past Thursday sitting in a BMW in a parking lot in Middleboro and as Troopers and Officers approached, Lynch rammed two police vehicles as he fled onto Route 44.
He was pursued for a short period of time with authorities losing sight of him, and he was involved in another crash, which caused injuries, before being arrested in Raynham following a foot chase.
He is next scheduled to appear in court on July 14.
