A Carver man is facing Hate Crime charges after allegedly attacking another man at a gas station.

Kingston Police say that shortly after 7:30 a.m. Tuesday officers responded to 41 Main St., Cumberland Farms for a reported fight in progress.

The victim in this case, identified only as a black male, says he was at the pumps when a man, later identified as 46-year-old Gary Phillipo II, began yelling racial slurs before charging at him.

Phillipo reportedly kicked the victim and struck him several times, knocking him to the ground, and the victim fought back.

Police say the victim sustained several injuries including a suspected compound fracture to a bone.

An investigation determined that Phillipo was the primary aggressor and police say he continued to yell racial slurs and act irate in front of the officers.

He was taken into custody and later taken to a hospital where police say he continued to yell profanities and racial slurs at officers.

Phillipo was found to have a long history of violence and was arraigned on charges of: A&B with Dangerous Weapon causing Serious Bodily Injury; A&B to Intimidate resulting in Bodily Injury (Hate Crime); and Disturbing the Peace.

Phillipo remained in custody and is due back in court next month.
